If you are buying or selling a car in Utah, you need a Utah bill of sale. You may also need this form if you are buying or selling other kinds of property, such as a trailer, motorcycle, animal or firearm.

What Is a Utah Bill of Sale?

This document shows that a piece of property has been sold. The form can only be used for personal property like a car or animal. You need a different legal document if you are selling a house or transferring real property. And, if you are selling services rather than a product, you need a service contract instead.

The BoS form serves as proof of purchase of personal property. It is a simple summary of the transfer of property. It does not go into detail about many of the specific terms of a complex sale. A sales contract is needed for that. Instead, this simple form provides details on the following:

What property is being transferred Who owned the property before the transfer Who is buying the property and will own it after the transfer. When the new owner takes possession. What the new owner pays for the property.

Often, the BoS is a one page form or document created by a buyer and seller, by a lawyer or by using a standard form offered by the DMV.

What Is an As Is Form?

If a property is sold with no warranty or guarantee, then it is sold as is. This simply means the property is sold as it is in its current condition. An “As Is” BoS makes clear the seller takes no responsibility for future problems and that the buyer should make certain they understand the condition of the item as they will have no recourse once they have purchased it.

When Should I Use a Utah Bill of Sale?

If you are selling items in Utah, creating this document is a good idea to provide proof of purchase. Sellers benefit so they can show when a product changed hands and under what terms. Buyers benefit because they have written evidence they are the new legal owners of the product they bought.

Bills of sale are not required in every circumstance when property changes hands, but you do need to create one if you are selling a vehicle such as a passenger vehicle, heavy truck, motorcycle, snowmobile, off-highway vehicle, trailer, boat or motorcycle.

Form TC-843 is the standard form that is used when a vehicle changes hands in Utah. You can also create your own document as long as it includes the required information about the transaction.

Benefits of a Bill of Sale

Both the buyer and seller benefit from having a written record that a transfer of ownership has taken place. The buyer can use it to show they are now the owner of the property so they can register a vehicle. The seller can use it to show they are no longer the owner and are thus not responsible for any problems that may arise.

Both the buyer and seller can also refer to the form to see what property has changed hands and when. And third parties can also gather this information in case there is a dispute about ownership to resolve.

What Should Be Included?

A BoS form should include the details necessary to provide proof that a purchase took place. The specific details that should be written vary depending on exactly what type of product changed hands. In general, it should include:

Contact information for both the buyer and the seller A property description so the property that changed hands can be identified Information about the transaction including the price paid and the day the property changed owners

If you are creating a Utah bill of sale because a vehicle has been sold to a buyer, you can use Form TC-843, which can be found online. No, this does not have to be notarized. Both a handwritten and a typed or printed form will be recognized as valid, but a handwritten document should be in ink and not in pencil. The form should include details about the product being sold and should be signed by both parties but no notary signature is required on the forms.
